In accordance with laws, regulations and departmental management responsibilities, the Ministry of Education, the Ministry of Foreign Affairs and the Ministry of Public Security jointly formulated the Measures for the Administration of Recruiting and Cultivating International Students in Schools. It is hereby promulgated and will come into force on July 1, 2017.

The school's management measures for recruiting and training international students

Chapter I General Provisions

Article 1   These Measures are formulated in accordance with the Education Law of the People's Republic of China, the Exit and Entry Administration Law of the People's Republic of China and other laws and regulations, so as to regulate the school's recruitment, cultivation and management of international students, to facilitate international students' study in schools within the territory of China, to enhance educational exchanges and cooperation, and to raise the level of internationalization of Chinese education.

Article 2 "Schools" as used in these Measures refers to schools within the territory of the People's Republic of China that carry out preschool, primary, secondary and higher education.

"International students" as used in these Measures refers to foreign students who do not have Chinese nationality and are receiving education in schools according to the Nationality Law of the People's Republic of China.

Chapters 2 to 5 of these Measures apply to institutions of higher learning. Schools that implement preschool, primary and secondary education shall follow the regulations of provinces, autonomous regions and municipalities directly under the Central Government for their recruitment, teaching and management of international students.

Article 3 The University shall abide by Chinese laws, regulations and national policies in recruiting and training international students; National sovereignty, security and social public interests should be safeguarded; Management should be standardized and quality assurance.

International students should abide by Chinese laws and regulations, respect Chinese customs and habits, abide by school rules and regulations, and complete school learning tasks.

Article 4  The administrative department of education under the State Council shall make overall plans for the management of international student work nationwide, be responsible for formulating macro policies for recruiting and cultivating international students, guide and coordinate the administrative departments of education and schools of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in carrying out international student work, and may entrust relevant units and industry organizations to undertake the management and service of international students.

The foreign affairs, public security and other administrative departments of the State Council shall, in accordance with their duties and division of labor, do a good job in the relevant management of international students.

Article 5  The administrative departments of education of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall guide, coordinate and supervise the work of international students within their respective administrative regions, and shall be responsible for researching and formulating relevant policies for the work of international students at the preschool, primary and secondary education stages within their respective administrative regions.

The foreign affairs, public security and other administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall do a good job in the relevant management of international students in accordance with their duties and division of labor.

Article 6 Schools recruiting international students shall establish and complete systems for the recruitment, training, management and service of international students, and shall be specifically responsible for the recruitment and cultivation of international students.

Chapter II: Enrollment Management

Article 7  Schools of higher learning that recruit international students shall possess the corresponding educational and teaching conditions and cultivation capabilities, and independently recruit international students in accordance with the relevant provisions of the State.

Article8 Schools of higher learning that recruit international students shall file in accordance with the matters and procedures prescribed by the administrative department for education under the State Council.

Article 9  Institutions of higher learning recruit international students, and the categories of academic education are: junior college students, undergraduate students, master's students and doctoral students; The categories of non-academic education are: preparatory students, fellowships and research scholars.

Article10 Schools of higher learning shall independently determine the enrollment plans and majors for international students in accordance with their school-running conditions and cultivation capabilities, unless otherwise provided by the State.

Article11 Schools of higher learning shall, in accordance with the national regulations on admissions, formulate and publish their own international student enrollment brochures, and recruit international students in accordance with the conditions and procedures stipulated in the enrollment brochures.

Article12 Schools of higher learning shall examine the admission qualifications and economic guarantee certificates of foreign citizens who apply for admission, and conduct examinations or assessments. The admission of international students is determined by the school; For those who do not meet the enrollment requirements, the school shall not enroll.

Article13  Institutions of higher learning may, with the consent of the original enrollment school, accept international students admitted or transferred by other schools.

Article14  The fees and standards charged by institutions of higher learning for international students shall be implemented in accordance with the relevant provisions of the State.

Schools of higher learning shall publish the fee items, fee standards, and refund regulations for withdrawals and transfers for international students. Charges and refunds are denominated in RMB.

Chapter III: Teaching Management

Article15 Schools of higher learning shall include the teaching plan for international students in the school's overall teaching plan, select teachers suitable for the teaching of international students, and establish and complete a quality assurance system for education and teaching.

Article16 International students shall participate in course study in accordance with the curriculum arrangements and teaching plans of institutions of higher learning, and shall participate in corresponding graduation examinations or assessments in accordance with regulations. Schools shall truthfully record their academic performance and daily performance.

Chinese Language and China should be a compulsory subject in higher education education; Political theory should be a compulsory course for international students majoring in philosophy and political science.

Article17 After an international student enrolls, the international student may change majors upon the student's application and the consent of the institution of higher learning. The conditions and procedures for changing majors are prescribed by the school.

Article18 The standard spoken and written language of the People's Republic of China is the basic teaching language for the cultivation of international students in institutions of higher learning. For international students whose level of the standard spoken and written language of the country does not meet the study requirements, the school can provide necessary tuition conditions.

Article19 Qualified institutions of higher learning may offer international students professional courses that use foreign Chinese language for teaching. For international students who receive higher education in Chinese foreign language, the dissertation can be written in the corresponding foreign language, and the abstract of the dissertation should be Chinese; Whether or not to use foreign Chinese for dissertation defense is determined by the University.

Article20 Schools of higher learning shall organize international students to participate in teaching internships and social practices in accordance with their teaching plans, and shall comply with relevant national provisions in choosing internships and practice locations.

Article21  Institutions of higher learning shall issue academic certificates or other academic certificates to international students in accordance with the relevant provisions of the State. For international students receiving higher academic education, institutions of higher learning shall promptly handle electronic registration of student status and graduation certificates.

Institutions of higher learning issue degree certificates to international students who meet the conditions for awarding degrees.

Chapter IV: School Management

Article22 Schools of higher learning shall clearly define the working bodies responsible for the management of international students, and shall be responsible for the overall planning and coordination of the recruitment, teaching, daily management and service of international students, as well as the contact with alumni after graduation.

Article23 Schools of higher learning shall disclose to international students the basic situation of the school, the situation of education and teaching, the enrollment brochure and the management and service system for international students, so as to facilitate international students' access to information.

Article24 Schools of higher learning shall provide international students with necessary living service facilities such as food and lodging, and establish and complete and publish management systems for the use of service facilities. International students living outside the dormitory shall promptly go through the registration formalities at the public security department of their place of residence.

Article25 Schools of higher learning shall carry out education on Chinese laws and regulations, school discipline and school rules, national conditions, excellent traditional Chinese culture and customs and habits for international students, and help them familiarize themselves with and adapt to the study and living environment as soon as possible.

Schools of higher learning shall set up positions of international student counselors to understand the study and living needs of international students, and promptly do a good job in providing services in areas such as information, consultation, and cultural and sports activities. The proportion of international student counselors shall not be lower than the proportion of Chinese student counselors, and shall enjoy the same treatment as Chinese student counselors.

Article26  Schools of higher learning encourage international students to participate in cultural and sports activities that are beneficial to their physical and mental health, and provide convenient conditions for them to participate in cultural and sports activities. International students can voluntarily participate in public welfare activities and celebrations of major Chinese holidays.

Institutions of higher learning generally do not organize international students to participate in military training or political activities.

Article27  With the consent of institutions of higher learning, international students may hold activities to celebrate important traditional festivals of their own countries in designated places and scopes on campus, but shall not have content that opposes or attacks other countries or ethnic groups, or words or deeds that violate public morality.

Article28 With the approval of institutions of higher learning, international students may establish fraternity groups within the school, operate within the scope prescribed by Chinese laws and regulations, and accept the guidance and management of the school.

Article29  Schools of higher learning shall respect the ethnic customs and religious beliefs of international students, but shall not provide places for religious activities. No religious activities such as missionary or religious gatherings shall be conducted in schools.

Article30  International students may participate in work-study activities during their studies in institutions of higher learning, but shall not be employed, engaged in business or engage in other business activities.

The specific regulations on the administration of work-study for international students shall be formulated separately by the administrative department of education under the State Council in conjunction with relevant departments.

Article31  Institutions of higher learning shall carry out the management of the student status of international students with reference to the provisions of the Chinese Regulations on the Administration of Student Status. Where a school withdraws or expells an international student, it shall file it in accordance with the provisions of the administrative department of education under the State Council.

Chapter V: Scholarships

Article32 The Chinese Government shall establish Chinese Government Scholarships for international students receiving higher education and encourage local people's governments to establish scholarships for international students.

The administrative measures for the Chinese Government Scholarship shall be formulated by the relevant administrative departments of the State Council.

Article33 The administrative department of education under the State Council selects the best of merit and entrusts institutions of higher learning to train Chinese Government Scholarship students. Institutions of higher learning undertaking the task of cultivating Chinese Government Scholarship students shall give priority to recruiting Chinese Government Scholarship students.

Article34  Institutions of higher learning may establish scholarships for international students. Enterprises, public institutions, social groups, and other social organizations and individuals are encouraged to establish scholarships for international students, but unreasonable conditions must not be attached.

Chapter VI: Social Management

Article35  Foreigners applying to study in the schools referred to in Article 2 of these Measures shall, according to the period of study, apply for an X1 or X2 visa to the Chinese embassy or consulate in the country of nationality or residence or other overseas institutions entrusted by the Ministry of Foreign Affairs before entering the country of study, and submit relevant materials such as certificates recorded by the competent department of education and admission notices issued by the school in accordance with regulations.

Article36 If an international student holding a study visa indicates that he or she needs to apply for a residence permit after entry, he or she shall, within 30 days from the date of entry, apply to the exit and entry administration department of the public security organ of the place of residence for the study type foreigner for a residence permit.

Article37  Where the Ministry of Foreign Affairs has other provisions on the application of personnel of foreign diplomatic missions, consular offices and representative offices of international organizations in China and their accompanying family members to study in schools, they shall be implemented in accordance with the provisions of the Ministry of Foreign Affairs. If the relevant procedures are not completed in accordance with the regulations, the school shall not enroll.

Article38  When the University enrolls international students under the age of 18 whose parents do not reside in China, the University shall require their parents to formally entrust a foreigner or Chinese resident in China to serve as the guardian of the international student and provide relevant supporting materials.

The school can accept international students who study in groups for a short period of time, but they should sign an agreement with the foreign sending agency in advance. Where schools implementing primary or secondary education accept short-term study of international students in the form of groups, the sending unit of the foreign party shall, in accordance with the laws of the country where it is located, go through the legal formalities required for organizing the entry and exit of minors in advance, and shall send personnel to accompany the group and serve as guardians for the international students during their study at the school.

Article39  When enrolling, international students shall, in accordance with the regulations of the Chinese health administrative department, go to the Chinese health quarantine department to go through the confirmation procedures of the "Physical Examination Record for Foreigners" or undergo a physical examination. Where it is confirmed after physical examination to have a serious mental disorder, infectious tuberculosis or other infectious diseases that may cause major harm to public health as provided for in the "Exit and Entry Administration Law of the People's Republic of China", the public security departments shall handle it in accordance with law.

Article40 The University implements an insurance system for all international students. International students must be insured in accordance with relevant national regulations and school requirements. For those who fail to purchase insurance in accordance with the regulations, they should apply for insurance within a time limit, and if they do not apply for insurance within the time limit, the school will not admit them; Those who have already studied at school should be withdrawn or not registered.

Chapter VII: Supervision and Management

Article41  The administrative department of education under the State Council shall establish and complete a system for supervising the quality of international student training. The administrative departments of education of provinces, autonomous regions, and municipalities directly under the Central Government shall supervise the cultivation of international students in their respective administrative regions.

Article42  The State Council administrative departments such as for education, public security, and foreign affairs responsible for the management of international students shall use modern information technology to establish an international student information management system, promote information sharing work mechanisms, and continuously improve the management and service of international students.

Article43 Public security and other competent departments shall handle international students who violate the provisions of laws and regulations such as the "Law of the People's Republic of China on the Administration of Exit and Entry", the "Law of the People's Republic of China on Administrative Punishments for Public Security", the "Regulations of the People's Republic of China on the Administration of the Entry and Exit of Foreigners", and the "Provisions of the People's Republic of China on the Administration of Religious Activities of Foreigners within the Territory of the People's Republic of China".

Article44 Where an institution of higher learning exhibits the following acts in the process of recruiting and cultivating international students, the competent administrative department for education shall order it to rectify and pursue legal responsibility in accordance with the relevant provisions of the Education Law of the People's Republic of China, and may restrict its recruitment of international students:

(1) Violating state regulations and school enrollment regulations;

(2) Profit-making behavior in the process of enrollment;

(3) Failing to disclose the items and standards for charging fees, or failing to collect fees according to the items or standards;

(4) Issuing degree certificates, academic certificates or other academic certificates in violation of regulations;

(5) Poor teaching quality or inadequate management and services, causing negative social impact;

(6) Other violations of laws and regulations.

Chapter VIII Supplementary Provisions

Article45 For the purposes of these Measures, short-term study refers to studying in Chinese schools for no more than 180 days (inclusive), and long-term learning refers to studying in Chinese schools for more than 180 days.

Article46  Where international students are recruited by scientific research institutions within the territory of China that have been approved to undertake postgraduate education tasks, these Measures shall be followed.

Where educational institutions approved by the administrative department of education to implement non-academic education recruit international students, these Measures shall be implemented with reference to these Measures.

The recruitment, training and management of students from the Hong Kong Special Administrative Region, the Macao Special Administrative Region and the Taiwan Region, as well as the recruitment, training and management of schools for foreign children in China, shall be implemented in accordance with other relevant provisions of the State.

Article47  The departments of education, foreign affairs, public security, and other such departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, on the basis of these Measures, formulate management regulations for that province, autonomous region, or municipality directly under the Central Government.

Article48 These Measures shall take effect on July 1, 2017. The Regulations on the Administration of the Acceptance of Foreign Students by Institutions of Higher Education promulgated by the Ministry of Education, the Ministry of Foreign Affairs and the Ministry of Public Security on 31 January 2000 and the Interim Measures for the Administration of the Acceptance of Foreign Students in Primary and Secondary Schools promulgated by the Ministry of Education on 21 July 1999 shall be abolished at the same time.
